SoCO Eats may provide you with the option to purchase or redeem gift cards in connection with your use of the Platform. You agree that you will comply with all gift card terms and conditions, which are incorporated by reference and are located here. 

 

In addition to and without limiting the rights and obligations set forth in the SoCO Eats' Terms of Service and SoCO Eats’ Privacy Policy (collectively, the “Agreement”), these SoCO Eats Gift Card Terms and Conditions and Merchant Gift Card Terms and Conditions (collectively, “Gift Card Terms”) are between SoCO Eats LLC (“SoCO Eats”) and the purchaser or redeemer of a SoCO Eats Gift Card or Merchant Gift Card (“you”). The SoCO Eats Gift Cards and Merchant Gift Cards are collectively referred to as the “Gift Cards”. These Gift Card Terms govern your purchase, receipt, and redemption of SoCO Eats Gift Cards and Merchant Gift Cards. These Gift Card Terms constitute a legal agreement between you and SoCO Eats. In the event of any conflict or inconsistency between these Gift Card Terms and the Agreement, these Gift Card Terms shall prevail.

 

SoCO Eats Gift Cards

Redemption

SoCO Eats Gift Cards ("SoCO Eats Gift Cards") may only be redeemed toward the purchase of eligible goods on the platform provided by SoCO Eats. Your use of the platform available via www.socoeats.com and the SoCO Eats app shall be subject to SoCO Eats’ Terms of Service and SoCO Eats’ Privacy Policy.

 

You must have an active and valid SoCO Eats account to redeem the SoCO Eats Gift Card. SoCO Eats Gift Cards are automatically applied to your SoCO Eats account (your “SoCO Eats Gift Card Balance”) once you enter the SoCO Eats Gift Card code. If you have other payment methods in your SoCO Eats account, the SoCO Eats Gift Card Balance will be set as your default payment method. Purchases through SoCO Eats are deducted from your SoCO Eats Gift Card Balance. Any unused SoCO Eats Gift Card Balance will remain associated with your SoCO Eats account. If a purchase exceeds your SoCO Eats Gift Card Balance, the remaining amount must be paid with another payment method in your account.

 

No fees apply to your use of a SoCO Eats Gift Card. You may apply your SoCO Eats Gift Card to payment of taxes, service fees, and delivery fees. SoCO Eats Gift Cards do not expire.

 

Limitations

SoCO Eats Gift Cards cannot be applied to the purchase of alcohol. Your SoCO Eats Gift Card Balance cannot be used to purchase other SoCO Eats Gift Cards. SoCO Eats Gift Cards cannot be reloaded, resold, transferred for value, used for payment outside of the SoCO Eats platform, used for unauthorized advertising, marketing, sweepstakes, promotional or commercial purposes, redeemed for more than face value, returned for cash, or redeemed for cash, except to the extent required by law. Unused SoCO Eats Gift Card balances in a SoCO Eats account may not be transferred to another SoCO Eats account. SoCO Eats Gift Cards may only be redeemed via the SoCO Eats app or website and are not redeemable outside of the United States, or in any United States cities where SoCO Eats is not available.

 

SoCO Eats places limits on the amount and value of Gift Cards you may purchase in any one given day and in any one given transaction. Currently, you may not purchase more than $100 worth of Gift Cards in any one day, and you may not purchase any Merchant Gift Card or SoCO Eats Gift Card worth more than $100 in any one transaction. SoCO Eats may update these limits from time to time in its sole discretion.

 

SoCO Eats Gift Cards cannot be used toward the purchase of Restaurant Partner Supplies or Delivery Driver Gear. 

 

Risk of Loss

The risk of loss and title for SoCO Eats Gift Cards pass to the purchaser upon our electronic transmission of the SoCO Eats Gift Card to the purchaser or designated recipient, or our delivery to the carrier, whichever is applicable. We are not responsible if any SoCO Eats Gift Card is lost, stolen, destroyed or used without your permission.

 

Fraud

SoCO Eats reserves the right to any remedy, including refusal to issue or honor a SoCO Eats Gift Card in the event of suspected fraud. We will have the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained SoCO Eats Gift Card is redeemed and/or used to make purchases on SoCO Eats.

 

Limitation of Liability

WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO SOCO EATS GIFT CARDS OR YOUR SOCO EATS GIFT CARD BALANCE, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A SoCO Eats GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH SoCO Eats GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

 

Disputes

Any dispute or claim relating in any way to Gift Cards will be resolved in accordance with the Dispute Resolution and Arbitration section of SoCO Eats’ Terms of Service.

 

General Terms

The SoCO Eats Gift Card is issued by SoCO Eats LLC When you purchase, receive or redeem a SoCO Eats Gift Card, you agree that the laws of the State of Colorado, without regard to principles of conflict of laws, will govern these SoCO Eats Gift Card terms and conditions. We reserve the right to require additional verification of your identity, SoCO Eats Gift Card or account ownership, or provision of an additional payment instrument, before you are able to apply a SoCO Eats Gift Card to your account or your SoCO Eats Gift Card Balance to a purchase. We reserve the right to change these terms and conditions from time to time in our sole discretion without notice to you, subject to applicable law. The most current SoCO Eats Gift Card Terms shall be available at https://socoeats.com/pages/gift-cards, and will supersede all previous versions of the SoCO Eats Gift Card Terms. The most current SoCO Eats Gift Card Terms shall be effective upon SoCO Eats’ posting of such modified SoCO Eats Gift Card Terms. Your purchase, redemption, or use of any SoCO Eats Gift Card or portion of any SoCO Eats Gift Card Balance after such posting constitutes your acceptance of the modified SoCO Eats Gift Card Terms. If any term of these SoCO Eats Gift Card Terms is deemed to be invalid, void, or for any reason unenforceable, such term shall be deemed severable and will not affect the validity and enforceability of any remaining terms of these SoCO Eats Gift Card Terms. All terms and conditions are applicable to the extent permitted by law.
